Zanima me da li tvrtke mogu tužiti državu na Europskom sudu za ljudska prava ako im suđenje nije bilo pravedno (recimo, sudac odbija saslušati svjedoka i slično). Evo što sam našao na stranicama Financijskog pravobranitelja (ombudsmana) u Velikoj Britaniji:

"In the end, to preserve competition for the benefit of the consumer, firms may have no alternative but to turn to the human rights legislation. Article 6 of the European Convention on Human Rights, part of UK law since the passing of the Human Rights Act 1998, states that, in the determination of civil rights and obligations, everyone is entitled to a fair and public hearing by an independent tribunal established by law.
Judicial decisions make it clear that not only individuals, but also corporate bodies have human rights. It is possible that this legislation will give firms a right of appeal not available to them through the Financial Services and Markets Act."
